Punishment vs. Rehabilitation

◆ Pros
 I believe that punishment is more important than rehabilitation for the four following reasons.
 The first reason is that, considering the feelings of victims and their family, it is extremely unfair that criminals are not punished severely enough. For example, if a person killed someone and the murderer is not punished accordingly, it would be extremely poignant. This kind of thing is just too unfair.
 The second reason is that punishment is an effective deterrent to crimes. It is very easy to imagine that, if there is no punishment at all, the world will become chaos. Human beings are emotional animals so that each and every person sometimes feels strong anger and becomes very violent. However, due to possible punishment, many people would not resort to violence
 The third reason is that rehabilitation costs a lot. It is unreasonable to spend so much people’s tax money on criminals. The money should be spent on law-abiding people rather than criminals.
 The fourth reason is that ex-convicts commit crimes again after they were supposed to be rehabilitated. Considering that the crime rate of ex-convicts is really high, so-called rehabilitation is not as effective as punishment.
 For the aforementioned four reasons, I believe that punishment is more important than rehabilitation.

◆ Cons
 I believe that rehabilitation is more important than punishment for the three following reasons.
 The first reason is that, if people are punished every time they make a mistake, the world will become worse and worse. No one is perfect and all the people make mistakes. Punishment deprives people of the opportunity to learn from mistakes and try again in a better way and improve the world.
 The second reason is that no one has the right to punish others. Human beings are not God. The government is not God. It is unethical for people to punish others. Moreover, law is not perfect. The majority is not necessarily always right. For example, Galileo Galilei was severely persecuted and punished because he insisted heliocentric theory while the majority believed geocentric theory. Later, it turned out that he was right and the majority was wrong. How would you feel if you were him?
 The third reason is that rehabilitation will make the world better. There are many examples that people who committed crimes were rehabilitated and became great people who contribute a lot to society. Punishment will ruin this opportunity.
 For the aforementioned three reasons, I believe that rehabilitation is more important than punishment.

例によって、賛成派と反対派を書きました。

罰則派では、
「被害者やその家族の気持ちを考えると、加害者が厳しく罰せされないのは、あまりにも不公平」
「罰則は効果的な犯罪の抑止力」
「更生はコストがかかる」
「更生されたはずの犯罪歴のあるものの再犯率が高い」
というのを、メインに、書いてみました。

反論としては、
「厳しく罰した後に更生する事も出来るのでは?」
「死刑になりたくて犯罪を犯す者もいるので、必ずそうとは言えないのでは?」
「コストがかかっても更生をしないと、死刑判決を受けたもの以外は、また犯罪を繰り返すのでは?」
「だからこそ、もっと更生に力を入れないといけないのでは?」
などが考えられます。

更生派では、
「失敗するたびに罰せられたら、世界はどんどん悪くなる」
「人間に人間を罰する権利はない」
「更生は世界を良くする」
というのを、メインに、書いてみました。

反論としては、
「罰がないほうが、世界は無秩序になりどんどん悪くなるのでは?」
「罰則とは、人間が人間を罰すると言うより、皆が決めたルールに則る結果で、公平ではないか?」
「全ての犯罪者を更生できるとは限らないし、コストもかかるし、本当にそうとは限らないのでは?」
などが考えられます。
